£95,000 damages for pedestrian injured by uninsured driver

Mr D from Kent was involved in a road traffic accident on the 25th November 2017. He was crossing Roosevelt Road in Dover, at the junction with Old Park Hill.

He was about two feet from completing the crossing when an uninsured driver drove on the wrong side of the road and struck Mr D, resulting in a severe knee injury. As a result of the impact, Mr D was flung into the air through the car’s front windscreen, before landing on the road.

The driver of the vehicle was convicted of driving without insurance and failing to stop after an accident. He was sentenced to two years in prison and banned from driving for four years.

Mr D approached Girlings Personal Injury Claims to represent him in a personal injury claim against the driver.

Due to the driver being uninsured, a claim was made against the driver and the Motor Insurers Bureau. Proceedings were issued out of the High Court in London.

Expert evidence was obtained from a Consultant Orthopaedic Surgeon, a Consultant Psychiatrist and Forensic Accounting expert due to the fact that part of the claim included income lost to the client from his business.

The Defendant initially put forward an offer of £65,000 which was rejected. Following a case management hearing before the Judge to discuss the court timetable and budgeting of the claim, settlement was agreed in the sum of £95,000.
